Fairfax County ALU Rules — Basement & Garage (Current)

Fairfax County adopted its current ALU ordinance in July 2021. Both basement apartments and attached garage conversions are permitted as interior ALUs — the attached garage shares the primary dwelling envelope and bypasses detached-unit restrictions.

Loudoun permits accessory dwellings in residential and agricultural zones. Both basement and garage conversions are viable — the key variable is whether the garage is attached or detached.

Prince William County — Basement & Garage Changes in 2027

PWC currently prohibits accessory dwellings in residential zones — both basements and garages. This changes fundamentally under Virginia Senate Bill 531. Attached garage conversions may have a viable path today under Virginia Code § 15.2-2291, but should be verified with PWC Zoning before proceeding.

Virginia SB531: The New Statewide ADU Law

Senate Bill 531 was signed into law in April 2026, requiring all Virginia localities to permit ADUs by right in single-family residential zones by July 1, 2027. It covers both basement and garage conversions.

Can I convert my attached garage into an ALU?

Yes — in most cases an attached garage is the clearest path to a legal ALU. Because it shares a wall with the primary dwelling, it's treated as an interior conversion in Fairfax, Loudoun, and Arlington, which means the same administrative permit process as a basement. Detached garages have more restrictions and vary significantly by county.

What's the difference between converting a basement vs. a garage?

Both can produce a fully legal, rent-earning unit, but the trade-offs differ. Basements are typically lower cost ($60K–$150K) and already inside the home. Garage conversions ($90K–$200K for attached; more for detached) can offer better natural light and a more apartment-like feel, but may require addressing heating, insulation, and foundation drainage. We assess both options during our initial consultation.

Can I rent my unit to anyone, or does it have to be family?

In Fairfax, Loudoun, and Arlington, you can rent to anyone. The 2021 zoning updates removed all age, disability, and family relationship requirements. For Prince William County, tenant relationship requirements will be prohibited statewide starting July 1, 2027.

Does my HOA have to allow an ALU even if the county does?

No. HOA covenants and property owners association rules are not overridden by county zoning or Virginia's new state law. If your HOA explicitly prohibits rentals or secondary units, that restriction stands. We review HOA documents as part of our consultation. Note: Arlington County has no HOAs in its single-family neighborhoods, making it the cleanest market for both unit types.

How long does the permit process take?

In Fairfax and Arlington Counties, administrative permits are often approved within two to four weeks for both basement and attached garage conversions. Loudoun detached garage conversions requiring a Special Exception can take 3–6 months. Properties on well or septic systems require Health Department approval, which adds time regardless of conversion type.

Can a basement or garage ALU have a stove or oven?

Yes, but appliance choice affects cost. A kitchenette (fridge, sink, countertop cooktop) satisfies code easily. Adding a freestanding stove or oven triggers specific 2018 Building Code requirements for fire-rated assemblies. This applies equally to basement and garage conversions — and for garages, fire separation between the unit and the main house is required under Virginia Building Code regardless of appliance choice.

Do I need to live in the home to have a rental unit?

In Fairfax County and under the new 2027 state law, the owner must occupy either the main dwelling or the ALU. Loudoun County is unique in that it does not currently have an explicit owner-occupancy requirement for certain accessory dwellings. Arlington currently requires owner occupancy as well.

Can I use Airbnb for my basement or garage ALU?

Generally, no. Short-term rentals (under 30 days) are a separate zoning category. Most ALU permits require a minimum 30-day lease term. Operating an Airbnb usually requires a different, specific permit and has much stricter localized rules regardless of whether the unit is a basement or garage conversion.
